Appellant Enrique Martinez sued appellee Carlos Becerra for damages arising out of an automobile accident which occurred on December 31, 1985. Suit was timely filed on December 30, 1987. Personal jurisdiction over the proper defendant was not obtained until March 17, 1989, when appellee filed an answer. See Tex. R. Civ. P. 121. The trial court granted summary judgment based on limitations. By three points of error, Martinez contends that the trial court erred in granting summary judgment, arguing that a fact issue exists regarding diligence in service of process. We reverse and remand.
